The legal status of psilocybin truffles
Fresh psilocybin truffles are completely legal in the Netherlands. They can be freely produced, traded and sold. They are explicitly not mushrooms, so there is a different legal status.
The truffles we sell fall under food supplements according to European directives and meet all applicable safety standards.
To be more specific, the psilocybin truffles fall under the European guidelines for, among other things, herbs. The EFSA, the European Food Safety Authority, states that it concerns botanical products. EFSA itself says the following on its website: “Botanical and derived preparations made from plants, algae, fungi or lichens are generally available on the EU market in the form of food supplements”.
The psilocybin truffles contain only 1 to 2 milligrams of psilocybin per gram of fresh truffles.
The truffles that form the raw material for our product grow from the ground. The natural process leads to firm and dry fungi, and explicitly no mushrooms. The product therefore does not fall under the mushroom law. This makes psilocybin truffles legal, while (magic) mushrooms are not.
Since several incidents with magic mushrooms in 2008, especially in Amsterdam, the Dutch government has declared fresh mushrooms illegal. The law only mentions ‘the mushroom’. The magic psilocybin truffle is not a mushroom, but a mushroom substrate known as sclerotia.
Fresh psilocybin truffles: 100% legal in the Netherlands
The hallucinogenic substance in psilocybin truffles that provide the magical effect are listed in the Psychotropic Substances Convention (PDF). This means that the possession of pure psilocybin is prohibited.
There is an exception for natural products because the United Nations has found that the
substance is found in many fungi. The Convention on Psychotropic Substances (Article 32, point 12) explicitly mentions that Peyote cacti and Psilocybe truffles, among others, are excluded from the Convention, so they are legal.
The possession of psilocybin truffles is therefore completely legal. Only if you extract or synthesize the psychoactive substances you are in violation of the current legislation.
Shipping to other (EU) countries
The psilocybin truffles are legal in the Netherlands. This means that based on the principle of mutual recognition of goods in the European Commission they can be shipped to all other EU countries. The EU-treaty states that if a product is legal in one country, it can be sold and shipped to any other EU country. (MORE INFO)

The Coordination Point Assessment and Monitoring of new drugs (CAM is part of the National Institute for Public Health and the Environment (RIVM)) has carried out a risk assessment for sclerotia a.k.a. hallucinogenic / magic truffles. The CAM concluded that the number of health incidents related to the use of sclerotia is very low. Based on the CAM report, the Netherlands decided not to prohibit sclerotia.
From a letter dated 13 September 2001 from Herbert Schaepe, secretary of the UN International Narcotics Control Commission, to the Dutch Ministry of Health:
“Under international law there are currently no plants (natural material) containing psilocin and psilocybin under the control of the 1971 Convention on Psychotropic Substances”.
In most UN member states plants (natural material) containing psilocin and psilocybin are apparently legal. Within the EU there is the right to free movement of goods. However, countries with restrictive drug policies have changed their laws. We do not have the resources to check whether sclerotia and truffles are legal or not in every EU Member State. We strongly advise you to first investigate and determine whether sclerotia or truffles are legal in the country where you live. All the products we sell are legal in the Netherlands, the legal status of our products outside of the Netherlands differs per country. Though we do ship our products to most countries in the world, it is the customer’s own responsibility to check the legal status of the products in the country to which you order your package to be send. Therefore you automatically safeguard GO Microdose from any form of legal liability.
European Law
EU trade law says that if a product is legal in 1 EU country it is therefor in effect legal in ALL EU countries. So in case our types of products are not allowed by your government: the ban in your country is illegal, not our products. This logic follows from the jurisprudence which relegalized absinthe in the EU.
Our products are 100% legal in Holland. There is no priority for custom control in EU countries to look for shroom products. Health risks for shrooms are very low, when compared with other drugs such as alcohol or cocaine.
